Abstract

Users’ personal data circulate in the digital market. The purpose of this paper is to analyze this real situation from the perspective of contract law and Regulation (EU) 2016/679 on data protection. The contract of adhesion for the transfer of personal data is formalized in the context of the digital market, and users are the weaker party in the contract, and their consent to the data treatment is not always informed and free. I propose some solutions to improve the position of the personal data owner.
