The Community Law of Public Contracts: An Infravalorated Pillar of the Overcoming of the Nationalism and of Construction of the European Identity

Abstract

Since the accession of Spain to the European Communities in 1986, Spanish legislation on public contracts has accepted the principle of nondiscrimination by nationality, abandoning the national protectionism of contractors present in Spanish legislation. Law 9/2017 on Contracts of the Public Sector consolidates that historical process of adaptation of the Spanish legislation of public contracts. A European identity appears in the European Law of Public Contracts, a «European nationality» of the national contractors of the Member States.

Humberto Gosálbez Pequeño, University of Córdoba
Humberto Gosálbez is Associate Professor of Administrative Law at the University of Córdoba (Spain. He has been awarded two six-years research periods (CNAI). He has participated in 12 regional or national research groups. He is the author of three books, two legal theory-practice books and a sectorial legislative Code. Dr. Gosálbez is also the co-author of 3 university legal Manuals and a commented administrative Legislation. He has written many chapters of collective books (15) and many studies in legal Journals (25).
