Regulation of bathing waters in the European Union: how can it make a virtue out of necessity?

Abstract

The regulation of bathing water quality in the European Union has its roots in the 1970s, with the adoption of the first directive on the subject (Directive 76/160/EEC). This was succeeded, more recently, by Directive 2006/7/EC, which is currently undergoing a process of discussion, and, eventually, revision. This paper analyzes the regulation carried out to date, the proposals for its improvement and the problems and obstacles encountered in the implementation of the objectives outlined by the aforementioned directives. This is a subject where environment, safety and health are intertwined, against the backdrop of the recreational use of bathing waters (marine and freshwater) in safe sanitary conditions.

Author Biography

María Isabel Torres Cazorla, Universidad de Málaga, Spain

Associate Professor of Public International Law and International Relations at the University of Málaga. Her doctoral thesis concerned «State Succession and the Nationality of Private Persons». A remarkable issue of her career was her cooperation with the Special Rapporteur of the International Law Commission of the United Nations in Geneva, on unilateral acts of States (2003-2006). She was Editor-in-Chief (2009-2013) and Secretary (2006-2009) of the Spanish Yearbook of International Law. She is the main researcher of the Research Project PID2021-122143NB-I00, concerning Environment, Security and Health. She has been visiting scholar and researcher in the Università degli Studi di Urbino (2023) and the Università degli Studi of Salerno (2024). She has given international lectures in Tamaulipas, Mexico; United Nations, Geneva; Universidad Centroamericana, Managua; Universidad del Rosario, Bogotá; Universidad Central de Venezuela, Caracas; Universidad de Panamá; Universidad Paris-Nanterre, Paris; Academy of Sciences of Warsaw, Poland; University of Lviv, Ukraine; University of Cagliari, Urbino and Salerno, in Italy; Ateneo Manila University, in the Philippines, among others.
