The biased development of the Aarhus convention in the European Union. Justice for the environment?

Abstract

This paper takes a reflective approach to the exercise of jurisdictional action for the defence of the environment by citizens. The exercise of jurisdictional action for the defence of the environment by citizens, and in the face of the current climate emergency, questions the existence of an adequate and effective judicial protection in environmental matters based on the Aarhus Convention. It also raises the possibility of obtaining judicial protection for the protection of the environment through various jurisdictional mechanisms.

Author Biography

Andrea Spada Jiménez, Universidad de Málaga, Spain

She holds an international PhD in Law, Cum Laude and has been awarded the prize for the best Doctoral Thesis at Málaga University. She is Professor of Procedural Law, Criminal and Civil Proceedings at University of Malaga (Spain). She is the author of several publications, most notably her book «Climate Justice and Procedural Efficiency». She has directed and coordinated other works on the current procedural system, as well as authoring journal articles. She is a leader researcher on a project on Sustainable Development Goals and is also a member of several research projects. She is an editor member in certain research journals and she also has carried out international research stays for several months in other prestigious Universities at Italia, Spain and United States.
